If you've ever received a traffic ticket in California, you know how expensive it can be.

You can pay the fine, go to traffic school, or fight the ticket in court. But one website is helping traffic violators beat their tickets without ever stepping foot in a courtroom. And what may seem like a minor ticket could cost you quite a bit more than you think.

Take running a red light for example, once you add in all the court fees, it could cost you $500 to $600, plus a possible jump in your insurance.

Company founder Steve Miller claims most customers win their cases, but like any trial, there's no guarantee the court will rule in your favor.

But the website ticketbust.com says you have more options than you may think to fight the ticket if you know where to look.

But whether you were caught red handed or think you were unfairly ticketed, you have more options than you may think if you want to contest the ticket.

All you have to do is read the fine print.

"If you turn over the back of any ticket, it lists your options. You can go to court, you can request traffic school, or you can file a trial by declaration," said Steve Miller, CEO of ticketbust.com

Miller says that third option, a trial by written declaration, is a little known but highly useful way to fight your ticket. And you don't have to go to court.

You can instead argue your case in writing.

"You can put together your statement, you can think through it, put all the relevant facts, relevant information in a written statement, submit it to the court, the court then submits it to the officer, the officer responds and the court renders its decision," Miller said.

Every year, nearly 18 million traffic tickets are given out in California.

But less than 5% are contested in court.

Of that 5%, about 10% are contested through a written declaration.

If you fight a traffic ticket in court, your best hope is that the officer who cited you doesn't show up.

But Westlake Village company TicketBust.com has found a less risky way to tilt the odds in a driver's favor: a little-known legal maneuver called trial by declaration. That tool allows drivers to fight tickets through the mail instead of in court, and the company estimates it gets tickets dismissed for about three-quarters of its customers.

"It gives you a huge advantage over just going to court," said TicketBust Chief Executive Steven Miller, an Internet entrepreneur who co- founded the company in 2003 with his brother after his sib- ling got a ticket.

So how does it work?

Customers enter some basic information about their ticket on the company's website and talk to a researcher who knows the technicalities of California traffic laws. For instance, a red- light camera ticket can be automatically dismissed if the citation isn't received within 15 days of the infraction.

But most challengers rely on submitting a written declaration to the court that details why the violator believes he or she is innocent. Under California law, that requires the officer to respond with a declaration, too.

"Officers do not like responding to written declarations," Miller said. "They're paid to go to court, not to do additional paperwork. If the officer doesn't respond, the case is dismissed."

The company, which charges $250 for its services, started out handling a few tickets a week and has been so successful that it now employees 14 who handle about 200 per week. Last year, the company had revenue of about $2 million.

Indeed, since TicketBust came on the scene, several copycats have followed, including TicketKick.com in San Diego and 2FixYourTrafficTicket.com in West Hills.

Two of the largest law enforcement organizations in the state -the California High- way Patrol and Los Angeles Police Department - dispute the idea that officers don't respond to written declarations. But Mike Gregg, an LAPD traffic officer, said he doesn't doubt TicketBust is a better option than fighting a ticket in open court.

"I think you probably do have a better chance if you write things out and put down a more cogent thought," said Gregg. "You don't want to just get up before a judge and say, 'I don't think I was going that fast.' They hate that. You're going to lose every time."

Have you ever heard about a business that can get you out of a traffic ticket? Read on.

It all started with one brother, Steve, who was working in the internet business and the other brother, Craig, who was out and about getting a traffic ticket. Well, Craig wasn't very happy about his ticket so he flipped it over to take a detailed read of the next steps. That's when he hit pay dirt and discovered the legal loophole. Wanting to test it out, Craig responded to the court and the ticket was dismissed.

Did he fight the ticket in court?

"That is a fallacy about going to court. Nine times out of ten, the officer does show up because they're supposed to show up. Your chances of getting the ticket dismissed in court are very, very slim," states Miller.

So the Miller brothers teamed up, with Steve at the helm, and in 2004 started their new business: www.ticketbust.com.

Talk about turning a lemon into lemonade.

With Craig's help, Steve turned the idea into a full-fledged business: helping people get out of paying traffic tickets. At first, Ticketbust.com directed all of their marketing efforts toward reaching commercial drivers who had a much higher traffic ticket incidence. (Unlike the rest of us, commercial drivers aren't offered the option to remove points by going to traffic school.) In short order, they attracted the consumer segment, as well, and in a eight short years, their business burgeoned.

Examiner.com was able to catch up with CEO, Steve Miller, for an interview to get a better understanding of his business model and expansion efforts.

EXAMINER: So tell us, what's the secret behind all of this?

MILLER: It really is all about "trial by written declaration", which is perfectly legal. What happens is we are contesting the ticket for you with a written declaration. The judge reviews it, then they have to send it to the officer, who has to respond to it in writing. Officers do not like paperwork. If an officer does not respond to the declaration, it is automatically dismissed. The chance of this happening is far greater than going to court in the hopes the officer doesn't show up.

EXAMINER: What is the percentage success rate?

MILLER: Every ticket is different, the situation is different, the courts are different. I can't give an exact percentage, but we believe that doing a "trial by written declaration" gives you a 60-70 percent chance of having the ticket dismissed. We believe that anything over a 50 percent chance is worth it.

EXAMINER: Do you charge a percentage? Or a flat fee?

MILLER: We have a flat fee regardless of the kind of ticket. We charge $100 service fee and $149 document processing fee. We also have a service fee refund for the service fee, in case we're not successful, they get $100 back. So you're really risking $149.

EXAMINER: Did the recession effect the business negatively or positively?

MILLER: We're actually recession-proof and in a recession we have more business because people don't have the money to pay for tickets. So that's even more of a reason to contest a ticket.

EXAMINER: Have you found ways to expand your business and do you plan to expand outside California?

MILLER: There's enough business in California, so no plans for expanding outside the state at this point. We have expanded in two ways. We created a Hispanic version of our website and a cell phone ticket website. Both of our expansion efforts have helped our growth in the past couple of years. You have to remember, we invented the industry so at the beginning we were only seeing about 9-10 tickets per week for the first couple of years. Now we are doing over 200 tickets a week, which is double the amount in 2010. Part of that is attributable to the addition of the Spanish and cell phone websites.

According to several sources, a traffic ticket can cost well over $2,000 over the 3-year life of the ticket. In California, the tickets stays on a driving record for 3-years, which means increased insurance premiums during that period, in addition to paying the local and state fees.

Just goes to show how inventive some entrepreneurs can be. Take a costly nuisance and create a business that alleviates the headache, saves money and presto! A new industry is born.

Los Angeles (NBC Los Angeles) (Wednesday, Dec 28, 2011) - A Westlake Village company called TicketBust is making a name by fighting traffic tickets by exercising your not-so-well known rights.

If you've been looking for a way to get out of a traffic violation ticket that was issued in California, a company in Westlake Village called TicketBust thinks you should talk to them first.

"There's 18 million tickets issued in California every year," says the company's founder and President, Steve Miller. "Only about nine percent of those tickets get contested every year."

Miller founded the company nearly eight years ago, after his brother got a ticket.

"He looked on the back of the ticket and most people don't turn over the ticket and read it," said Miller. "And it says that you can contest the ticket using a trial by written declaration. He did it on his own and won the ticket."

So, what is a trial by declaration?

"It's a way to present your case to the court without going into the court," explains Miller. "You complete the documents. You put all of your search and case together, send it in to the court, the court sends it to the officer, the officer responds to it and then the judge renders its decision."

Although anyone can do this, Miller says TicketBust has perfected the process.

Miller says his team of busters are constantly looking for different ways to get tickets dismissed. Their goal is to cut fines and keep the dreaded "points" off your driving record.

"We started with maybe 20 pages of defenses that we could use," says TicketBust consultant Alexis Vega. "Now we have over 400. The laws are constantly changing. It's important to constantly research the different laws."

While TicketBust can help with just about all traffic violations, it does have its limits. The service can't help minors, it won't deal with misdemeanors, unlicensed drivers or drunk driving cases. Miller says the company processes about 150 tickets each week.

"The bad economy has helped this business because people don't want to pay those outrageous fines," says Miller. "They are looking for places to help them legally contest a ticket and remove the points."

The company's expertise is not cheap. Miller says he charges $249 for most cases. There's a partial refund if the ticket is not dismissed.

And if the ticket isn't dismissed, all is not lost.

"You can take your shot at a trial by declaration," says Miller. "If it doesn't get dismissed, you are right back to where you are now. You can go to court or traffic school."

Speeding Tickets Fix Makes a Million

NEW YORK (http://money.cnn.com) (December 27, 2011) - Steve Miller's first instinct was to heckle his brother about his speeding ticket.

But then he saw a business opportunity in his brother's reckless-driving habit. In California, a process called "trial by written declaration" makes it easier to get a speeding ticket dismissed or the charge reduced. And it can be done without a court date.

The "trial by written declaration" is on the back of every ticket, but few people notice it, said Miller. "We really took something that anybody can do themselves and built a business around it," said Miller, 46.

TicketBust.com coaches California drivers in this little-known method to fight traffic infractions, such as speeding tickets, sign violations and blowing red lights.

Cool companies

Miller's enthusiasm for the business idea grew after his brother, through the "trial by written declaration" process, was found not guilty.

In 2004, he launched TicketBust.com in Westlake Village, Calif., as a one-man operation. Today, the company has 10 employees. Customers e-mail TicketBust.com details about their ticket. Then they send the company three signed copies of the Trial by Declaration form and pay $249 to have those forms mailed to the judge or another officer of the court. They also receive a copy of Miller's book: "Traffic Tickets: Don't Get Mad. Get Them Dismissed." There is a service fee refund that the ticket will either be reduced or dismissed.

Customers can also opt to purchase the book and do the process on their own.

In October of 2010, TicketBust.com passed over the $1 million in revenue mark. "One of our goals was to hit that mark. It was a feeling that you've achieved something, and now you need to set a new goal," he said. "In 2012, we plan to add another four or five employees."

Miller -- who serves as president and CEO -- had zero competitors when he launched TicketBust.com. Today, there are six. "It's really exploded in the last few years," he said. "There was nobody in California doing this at the time we started."

He is constantly trying to stay ahead of competing companies. He launched a free iPhone and Android app that allows customers to take a photo of the ticket, fill out a brief form and sign up with TicketBust.com. Only his company offers this perk.

He also beefed up his website. He has lots of dot-com experience, including running MediaHipp, an interactive agency with 70 programmers. He also heads up Tier3 Technologies, an IT-services company. "That gave me a lot of knowledge in how to put together a good website," said Miller.

Hollywood stuntman Thomas Bruggeman -- he's appeared in "Gone in 60 Seconds" and "Enemy of the State" -- was initially suspicious when he heard about TIcketBust.com. Still, he intended to battle his $395 ticket for allegedly going 85 miles per hour in a 65-miles-per-hour zone. TicketBust.com's extensive paperwork only fueled his concerns. "I called them up, told them it was B.S. and asked to speak with the president," he said. "We had a good talk." In the end, Bruggeman decided to try the service, and his ticket was dismissed. He also saved money. "If I hired a lawyer to fight it, it would have cost me $800," he said.

We're hiring!

Only nine percent of tickets are actually contested, Miller said. But that is quickly changing. By November, Miller estimated that TicketBust.com had worked on 38,000 cases. "The court likes it because it eliminates their court time and the courts are very full right now with cases that are backed up by months," said Miller. "There will always be traffic tickets. In this economy, our business has gone up, because people do not want to pay their tickets. People are more frugal about where they put their money."

Steven Lubell, a judge who sat on the bench for 11 years in Los Angeles Superior Court before retiring in March 2010, said some traffic tickets are issued in error, or for one-time mistakes: "A lot of municipalities get it wrong and calling attention to it is a good thing," said Lubell. "People make mistakes. People run a red light or go through a stop sign.

However, for repeat offenders, services like TicketBust.com might only enable the speeder, Lubell said. "If they're getting away with what they're doing and doing it again, that's not a good thing. If they're getting caught that many times, their traffic behavior needs to be reviewed."

QUESTION:  Why did you feel so compelled to have Steve on your show?
“I needed someone to fight for me without the service costing me an arm and a leg.  I thought many Californians were unaware of the services provided by TicketBust and wanted to help drivers reduce or eliminate ticket fines.  As so many drivers do, I was going to avoid the hassle and just pay the citation.  Then I realized that my excellent driving record would be blemished and frankly, I didn't want the points on my driving record as well as an inflated insurance premium.  Also, I was in the right.  It seems fairly clear that cities, towns, counties and states are seeking revenue and one of their primary sources is drivers that "they say" broke the law.  Think of it as a public service.
