Case Study: Class A Driver Busted for Speeding on I-5
Circumstances:
Ronald N., a certified Class A big rig driver was traveling northbound on I-5, amongst heavy commercial vehicle traffic.
The weather was clear and visibility was normal. Overall Ronald was driving at a speed which was reasonable or prudent having due regard for weather visibility, the traffic and the surface and width of the roadway on I-5.
When Ronald first observed the officer approaching in his side mirror and the officer was several hundred feet away. Ronald was on a straightaway, and the officer was heading downhill. According to Ronald, the officer was approaching at a fast pace. Ronald was driving in the far right lane amongst a line of eight other commercial trucks. There was one truck that decided to move around the rest of the trucks and that truck passed him on the left.
Ronald checked his speed periodically while driving and did so immediately prior to and after noticing the officer. His speed was 55 mph when the officer came into view, and that speed is significantly lower than the speed the officer wrote on the citation.
Problem:
Shortly thereafter, the officer directed Ronald to pull over. Feeling a sickness in his stomach, Ronald was cited with a speeding ticket under California Vehicle Code VC§22406 which carries a fine of $435 in the county Ronald was cited in.
According to DMV this violation description follows:
Maximum Speed for Designated Vehicles
22406. No person may drive any of the following vehicles on a highway at a speed in excess of 55 miles per hour:
(a) A motor truck or truck tractor having three or more axles or any motor truck or truck tractor drawing any other vehicle.
(b) A passenger vehicle or bus drawing any other vehicle.
(c) A schoolbus transporting any school pupil.
(d) A farm labor vehicle when transporting passengers.
(e) A vehicle transporting explosives.
(f) A trailer bus, as defined in Section 636.
According to Ronald, “the officer pulled me over claiming I was doing 65 down a hill in my Big Rig in a 55 mph posted speed limit. I was shocked with thoughts randomly crossing my mind points, costs, how would it effect my career and of course the ticket itself, I was unsure how this would all effect me but I knew one thing, I needed help.”
Ronald knew he had to find a way to fight and beat this speeding ticket. A speeding ticket would adversely affect his career and driving privilege gained as a Class A driver. His career as a Big Rig driver was all he had to support his family. Ronald placed numerous calls with much worry in his heart, but he was steadfast and wasn’t about to give up. He knew there had to be help out there. After many Internet searches and copious phone calls, he noticed that one company stood above the rest. Ronald says, “They didn’t guarantee me anything or falsify hopes to instill me with but the feeling I got from each individual assured me that they would do there best to protect my rights.”
Solution:
He found hope when he discovered Ticket Busters of California (TicketBust.com). Ronald spoke to Cristina, a traffic ticket consultant with TicketBust. After discussing a few significant facts of his citation, Cristina paired Ronald up with a speeding ticket expert named Alexis along with her assistant, Amanda to represent him. He also had communications with TicketBust’s CEO Steve. Each TicketBust representative played an essential role in assisting Ronald. Ronald claims that with each conversation his worried disposition began to change into phenomenal confidence. He knew he had made the right choice to get the help that TicketBust provides with their document filing services.
Alexis was working with a copy of the ticket which had been crinkled from Ronald’s frustration. After scrutinizing the copy, Alexis found a flaw in Ronald’s ticket. Since the officer was not relying on the use of radar and since there were so many trucks similar to Ronald’s on the road including the one that passed him, Ronald and Alexis questioned the accuracy of the officer’s method for calculating Ronald’s speed and whether the officer mistook Ronald’s truck for the truck which passed him. Ronald said that he was astonished that Alexis could pinpoint a flaw so quickly and he was very impressed.
Alexis explained exactly what she would need from Ronald in order to represent him during a process called Trial by Written Declaration.
- Ronald signed 3 original copies of the Trial by Declaration form, which he downloaded from the TicketBust site.
- He also had to sign the TicketBust Engagement Letter also available for easy download, which explains the process and the terms and conditions of the TicketBust Service and Money Back Guarantee.
- Additionally, in California, in order to contest a traffic ticket, the court requires you to post bail for a Trial by Written Declaration. Therefore Ronald had to also include a bail check*, made out to the court.
- The last step was to include a check for the TicketBust service.
*If you post bail directly with the court, you must inform the court that you are posting bail for a Trial by Written Declaration to contest your ticket. The court will refund your bail once your ticket is dismissed.
TicketBust uses these forms, etc. to submit the necessary documents to the courts. Some services simply give you a ‘boilerplate’ defense, and then leave the paperwork filing to the driver. TicketBust submits all documents to the court on behalf of their client, so the client doesn't have to go to court or even the post office.
Resolution:
That was it! That was all Ronald had to do and before he knew it, the court notified him directly within 30-90 days as to the disposition of his case.
Alexis not only got his ticket dismissed along with a fine of $435, she kept Ronald’s record clean of points. In Ronald’s line of work, it is imperative to have a good driving record.
Upon receiving a notice that the case had been dismissed and he would be getting a full refund of his bail amount, Ronald had these sentiments, “In her words that day she said to me ‘let’s see if we can’t get this dismissed for you’ and, by Golly, she meant it. That’s why it’s important to never give up. They might not get every ticket dismissed but best believe they are very sincere honest and will try harder then anyone. If there is a flaw in a ticket, they are going to find it. I’d put my faith in their hands before I’d ever call another ticket fighter. Thank you TicketBust for keeping my job in a “win/win” situation and most of all thank you for getting my ticket dismissed!"
