Beat Traffic Tickets
There are plenty of times when drivers are driving safely and within allowable speed limits yet they get pulled over because they are driving slightly over the speed limit or they make a driving maneuver that the officer deems illegal or unsafe. Here is a recent example of an officer making a hasty decision on a driver that was driving perfectly safe and in fact was looking to avoid a collision but was hit with a traffic ticket.
David Shu was driving in Santa Ana,CA and was approaching a red light that had a long line. He needed to make a left turn at the following light but did not want to pull into the restricted median area that was marked with a double yellow line. As he approached the light, the cars in front of him stopped abruptly and he was stuck in the middle of the intersection as the light was turning yellow and eventually red. Instead of causing a jam in the middle of the intersection, he pulled into the left restricted median section to prevent any collision or build up and proceeded down the median to the light where he needed to make a left turn. After reaching the light he was immediately pulled over and cited for illegally entering a restricted median zone.
This was David Shu's first traffic ticket and he was extremely disappointed that his actions to avoid any traffic collision or build up instead resulted in a hefty traffic ticket that he had to take time off work to fight in court.
This situation is a prime example of how a judge will overlook a minor traffic citation for the benefit of all drivers on the road. David Shu made the right decision by pulling to the empty median because the cars in front of him had stopped abruptly. The judge ultimately decided in favor of David Shu because he did not intentionally pull into the restricted median out of impatience but rather because he was looking to prevent any major build up in that intersection. The citation was dropped and David Shu's driving record remains scotch free.
Although the judge decided in favor of our defendant this time, it should be noted that the decision by this judge is strictly subjective to the situation. He was able to prove to the court that his actions were a result of the drivers around him speeding then stopping abruptly.
The majority of drivers that receive citations are generally innocent of their infractions but they were the ones that were picked out during that time.
